The Mexican Senate recently approved an amendment to the Mexican Federal Labor Law (FLL) moving an official mandatory holiday from 1 December to 1 October. The day off occurs once every six years to celebrate the inauguration of a new federal President.
This change entered into effect on 30 September 2024 and was implemented beginning 1 October 2024.
Background
The amendment to Section VII of Article 74 of the FLL aims at harmonizing this law with recent constitutional decrees which shortened the period between the presidential elections and the inauguration of the new federal President.
Key details
When this official holiday falls on a working day, employers are mandated to pay employees who work on this day off triple their daily salary, as follows:
- Payment of the regular daily salary
- An additional double salary for working on the official holiday
If the official holiday falls on a Sunday, employers are mandated to pay employees who work on this day off triple their daily salary, as well as an additional Sunday premium of twenty-five percent of their regular daily salary.
Employers who fail to comply with the payment requirements of the official holiday may face fines ranging from MXN 5,187 to MXN 518,700.
